Categorizing CBD and THC Amounts in Cannabis Sativa Plants

The amount of CBD and THC in your cannabis products depends on the specific type of plant that your product came from. Both CBD and THC can be found in cannabis sativa plants, and each plant can be classified according to its CBD and THC production potentials.

 

There are three types of cannabis sativa plants. Type I cannabis sativa contains more than 0.3% THC and less than 0.5% CBD. Type II cannabis sativa contains more than 0.3% THC and 0.5% CBD. Type III cannabis sativa contains less than 0.3% THC and more than 0.5% CBD. Type I and type II cannabis sativa are considered marijuana while type III is classified as hemp.

 

Due to federal regulations in the United States, only CBD derived from hemp is legal throughout the country, even though CBD can be derived from all types of cannabis sativa plant. All hemp-derived products are legal under the 2018 Farm bill if THC content is no more than 0.3% by dry weight. Any cannabis product, regardless of being derived from hemp, containing more than 0.3% THC by dry weight is illegal under federal law.

 

Because of varying state laws regarding both cannabis and hemp, some products are legal in some states while still illegal in others. At least 19 states now allow for adult recreational and medical use of cannabis. Medicinal cannabis use is allowed in 17 states. Low-THC/CBD products are legal in 11 states. There are 3 states that do not allow any cannabis use.
